Best2Serve B.V. is the share holder of BestPrints (hereafter known as BestPrints) for the sale of products offered through the internet e-commerce site BestPrints. In the event that a commercial transaction is formulated, the site is used exclusively by the Vendor.

1. Contents of the general sales conditions
The following general sales conditions apply to all the sales contracts between the Purchaser and the Vendor through the site BestPrints. Every contract is subject to the general sales conditions version published on the site at the time when the contract is finalized (see art.3).

Any alteration proposed by the Purchaser will not change the general conditions of sale unless they are expressly accepted in writing by the Vendor.

2. Contract parties and geographical area
The online store BestPrints is intended for the exclusive use of consumers; it is therefore reserved for retail sale.

Claims regarding the site and home delivery to the final Purchaser must be directed to the Vendor.

The products offered for sale through BestPrints will be delivered to the Purchasers who indicate an address which is situated in one of the countries included in the list of countries published on the website and accessible from any page of the website.

3. Provisions of the contract
All the information on the products published on BestPrints, such as technical specifications, images, dimensions or compatibility particulars are not binding and are subject to alteration at any time, unless they are expressly mentioned as being binding. In the event that the Purchaser is led into error by the above indications, he may withdraw the purchase as indicated in the Return Policy.

The offers on BestPrints are not binding for the Vendor and do not constitute an offer to the public, but are only an invitation to buy. The purchase order of the Purchaser constitutes a purposal binding on him. The purchase order is accepted by the Vendor through an order receipt sent via e-mail; the order receipt contains part of the sale conditions, the description of the product features, the main elements of the contract (price, means of payment), the order filing and storage of data methods arranged by the Vendor as well as the correction procedures of the order content.

The Contract is finalized between the parties and effective when the Purchaser receives the order receipt.

The order and the order receipt are considered to be received when the parties addressed can have access to the telematic messages.

In the event that the Purchaser does not receive the order receipt or any other communication from the Vendor within 24 hours of the forwarding of the order, the Purchaser is required to contact the Vendor in reasonable time. 4. Purchase of Products
The Products in the Catalogue may be purchased by selecting them and subsequently dropping them into the appropriate shopping basket. Once the selection of Products is completed and the Purchaser wishes to proceed to the purchase of the products placed in the basket, the Purchaser will be asked to provide the data required for the purposes of establishing the Contract. In particular, the Purchaser will be required to provide personal data in a proper section of the site, an e-mail address, any additional address for the delivery of the Products (where necessary), and a telephone number where he can possibly be contacted in order to communicate to him the delivery date.

If the Purchaser chooses to pay by credit card, he will be directed to the Internet site web page of the bank providing the "on-line" payment service, where the Purchaser must provide the credit card data through a secure connection.

For reasons of accounting, the Vendor reserves the right to verify general information left by the Purchaser.

In the event of payment by credit card, the total price of the purchase will be debited to the Purchaser after the Contract is finalized.

In the event of a special series or a limited-series Product order, the Vendor may reserve the right to allow the Purchaser only the purchase of a limited number of products, possibly lower than the total number of Products available for sale.

In any case, the Purchaser may submit an order for a number of Products larger than the number available indicated in the Catalogue. In such a case, the Vendor reserves the right to accept the proposal of the Purchaser for a number of pieces exceeding the maximum number indicated, subject to verification of the availability of the Products. The Vendor reserves the right, indeed, to accept the above proposal also subject to the fair distribution of the Products on the various markets.

It is understood that, should it be impossible to satisfy the order of the Purchaser for the number of pieces in excess, the Contract will be settled for the maximum number of Products available.

5. Delivery of goods
The availability of the product is the one indicated in the BestPrints online shop. The delivery times indicated are not binding, unless separately indicated in another agreement. Nevertheless, the Vendor will do everything possible to respect the times given.

The Vendor cannot guarantee that availability is accurate in every case. If such is the case, the Purchaser will immediately be informed that the goods will not be delivered and any payment made by the Purchaser will be reimbursed without further delay.

On receipt of the goods, the Purchaser must immediately check that the delivery is complete and correct and inform the Vendor of any problem without delay. In case of a problem regarding the delivery, please check the Help & contact page.

6. Prices , Tax and Transportation costs
The price of products is the price indicated on the price list of the online store, on the day at which an order is placed, before the order is sent out.

Prices that are mentioned on the website are meant for deliveries to addresses both inside as well as outside the European Union. All prices on the website are inclusive of VAT. Any extra costs for handling or shipment are determined by the type of shipment and the delivery address. These costs are shown separately before the order is placed, and are also shown in the order confirmation which is sent by email.

The VAT rate is determined by EU VAT laws. Various factors influence whether local or Dutch VAT needs to be levied on consumers.

7. Payments
The orders made on BestPrints can be paid by credit card. The Vendor may allow additional means of payment in the dedicated section on BestPrints. Details of the credit cards will be sent through a secure connection to docdata payments b.v., Hoofdstraat 82, 3972 LB Driebergen-Rijsenburg, The Netherlands (www.docdatapayments.com), which is a so called payment service provider and deals with payments via credit card for the Vendor.

The credit card data sent to docdata payments b.v., while the order is being made, is protected against unauthorised access, by means of cryptographic transfer of SSL data (Secure Socket Layer) at 128 bit.

All the current browsers support SSL cryptography. This data is not accessible to third parties.

8. Guarantee
8.1 Legal guarantee of the Vendor
The Vendor will issue a valid guarantee for the product for non-conformity to the quality required and declared on the contracts, according to and in application of directive 44/99/CE.

The guarantee enables the Purchaser, in the event of defect or non-conformity of the product, to obtain, by applying directly to the Vendor, in a reasonable period of time which depends on the nature of the goods, repair of the product (if possible), replacement of it, reduction of the price, or resolution of the contract.

The guarantee does not cover any use of the goods which is not the one established for the product by the Vendor/Manufacturer.

Any possible claim shall carry the evidence of purchase (receipt, fiscal document issued by the Vendor/ proof of the payment).

8.2 Commercial guarantee of the manufacturer
The Manufacturer releases a manufacture guarantee (commercial guarantee), which may be contained in the packaging. The duration, conditions and use of the guarantee are reported in the guarantee certificate.

This guarantee has no effect on the non-disposable rights of the Purchaser by virtue of law.

If the guarantee certificate attached to the product does not explain the procedure for exercising the guarantee in relation to the country in which the goods are received, check the Help & contact page. In such a case the following information must be provided:

a. Username of the Purchaser;
b. Product series #;
c. Product description;
d. Description of shortcoming found;
e. Type of intervention required;
f. Geographic area where the explanation is required.

8.3 Transmission of claims
The claim must be exercised by the Purchaser in time and not later than 60 days from the date on which the defect has been discovered. During this period the product must not be used.

The claim will be submitted electronically to the Vendor which will communicate immediately to the Purchaser the After Sales Point and the procedure according to which the product should be delivered to it.

The After Sales Point service may be managed directly by BestPrints through its own facilities instead of by the Vendor (but without dismissal on the Vendor's responsibility).

9. Responsibility for the product
The contents of Directive 85/374/CEE regarding damage caused by the product are valid. The Vendor, acting as the distributor, is freed of responsibility by indicating the name of the manufacturer.

10. Copyright
All the contents of BestPrints are protected by copyright. All the rights belong to BestPrints B.V.

This Internet site may not be reproduced in full or partially, transferred by electronic or traditional methods, modified, linked and used for public or commercial ends without the prior written consent of Best2Serve B.V.

11. Conclusive arrangements
If any clause of the present general terms and conditions should be invalid or should become invalid at a later date, this will not effect the validity of the rest of the present contract and the invalid clause shall be replaced with a clause that represents as faithfully as possible the original intent and economic purposes of the Parties or with an appropriate legal arrangement.

The Vendor reserves the right to amend the present general terms and conditions at any time.

12. Security
The users' data are protected to the maximum extent possible against loss, falsification, handling and improper use by third parties.

The Vendor also makes use of the services of Verisign. Verisign (www.verisign.com) guarantees:
- maximum levels of reliability and security to ensure to clients that the site is protected.
- that the information sent through the Web browsers or other devices remains confidential.

13. Applicable legislation and place of jurisdiction
13.1 The legislation applicable is that of the Netherlands, but the Purchaser cannot be denied rights deriving to him from the Laws of his country.

13.2 The forum for possible disputes is Breda, the Netherlands, except in case that any different law in favour of the Purchaser should be applicable.
